By joining the early-access list or using the Service, you agree to these terms. If you don't agree, don't use the Service. A pre-release build that comes with its own terms is governed by those.

1. Early access

Joining the list is free and doesn't guarantee an invitation; we decide whom to invite and when. Pre-release versions are unfinished: features may change, be withdrawn, or not ship, including those marked "Coming" or "Pending Apple".

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. Give accurate information when you sign up.

3. Using a pre-release app

VibeArmory monitors network traffic and, if you enable them, inspects HTTPS and restricts file access. Installing it, approving its system extensions and trusting its certificate authority are your decisions as the Mac's administrator. Use it only on Macs and traffic you are authorized to monitor, and keep backups.

4. Acceptable use

You will not, and will not allow anyone to:

We may investigate suspected violations and take action, including removing you from early access.

5. Privacy

The Privacy Policy describes what the website collects. The app keeps what it records on your Mac.

6. Availability and termination

The Service is provided on an "as available" basis with no uptime or availability guarantee. We may modify, suspend or discontinue it, or end your access for breach of these terms or as required by law. You may stop at any time and ask us to delete your signup. Sections 7 through 12 survive termination.

7. Intellectual property

The Service, the website, the software behind them and all related intellectual property are owned by us and our licensors. These terms grant you no ownership and only a limited, revocable right to use the Service. Our names, logos and marks may not be used without permission. We may use feedback you give us without obligation to you.

8. Warranty disclaimer

The Service and the website are provided "as is" and "as available", without warranties of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Service will be uninterrupted, error-free or secure, or that it will detect or prevent every threat.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law: (a) we will not be liable for indirect, incidental, special, consequential or exemplary damages, or for lost profits, revenue, data or goodwill; and (b) our total liability arising out of or relating to the Service will not exceed the greater of (i) the fees you paid us for the Service in the 12 months before the claim or (ii) USD $100.

10. Indemnification

You will defend, indemnify and hold us harmless from third-party claims, damages and costs (including reasonable legal fees) arising from your use of the Service, or your breach of these terms or applicable law.

11. Changes

We may update these terms. Material changes will be posted here with a new version and effective date before they take effect. Continued use after a change takes effect is acceptance of it. If you don't agree, stop using the Service.

12. Governing law; disputes; general

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or its Commercial Arbitration Rules where you use the Service for a business), before a single arbitrator, in English, seated in San Mateo County, California, or by video conference at your election; judgment on the award may be entered in any court of competent jurisdiction. Disputes will be arbitrated only on an individual basis, and each party waives any right to bring or take part in a class, collective or representative action. Either party may instead bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in the courts of San Mateo County, California, to protect its intellectual property or confidential information.

You will comply with applicable export-control and sanctions laws. These terms are the entire agreement about the Service. If any provision is unenforceable, the rest remains in effect. You may not assign these terms without our consent; we may assign them to an affiliate or successor. Our failure to enforce a provision is not a waiver of it.
